Terminate or take over the home lease

Typical deadline: 30 days after the death

If the deceased lived in a rented home, the lease does not end automatically. Notify the landlord in writing and agree either to terminate or to have a cohabitant or heir take over. Settle the deposit as well.

Steps

  1. Notify the landlord in writing, attaching the death certificate.
  2. Agree on termination or continuation of the lease and put it in writing.
  3. Arrange key handover, return of the deposit and final utility meter readings.

Documents usually needed

  • Death certificate

Frequently asked questions

Does the lease end automatically when the tenant dies?

Not automatically — the lease generally continues and the matter is settled by agreement: either termination, or continuation by a flatmate or heir. Notify the landlord in writing and put whatever is agreed in writing.

What happens to the rental deposit?

It is set off or returned when the property is handed over, as it would be in any normal end of lease. Arrange final electricity and water readings at the same time so the accounts close cleanly.
